Terms of Service

1. Definitions
In these Terms of Service:
- “Service” means the online ECG interpretation platform operated at ekg-apraksti.lv.
- “Company” means SIA “TeleCardiology”, registration No. 40103887688, Rīga, Latvia.
- “User” means any natural or legal person who registers for or uses the Service.
- “Order” means a request submitted by a User for an ECG interpretation report.
- “Report” means the written ECG interpretation produced by a cardiologist.
- “ECG File” means the electrocardiogram recording uploaded by the User.
- “Account” means the registered user profile on the platform.
2. About the Service
ekg-apraksti.lv is an online platform operated by SIA “TeleCardiology” that enables users to upload ECG recordings and receive written interpretation reports prepared by qualified cardiologists.
The Service is available to both private individuals and medical institutions. Use of the Service requires registration and payment of the applicable fee.
3. Medical Disclaimer
Important — please read carefully
The Reports provided through the Service are informational documents prepared by qualified cardiologists. They are not a substitute for an in-person medical consultation, diagnosis, or treatment.
In an emergency or if you are experiencing chest pain, severe shortness of breath, or symptoms of a heart attack, call emergency services immediately (112). Do not use this Service as your first response to an emergency.
Users are responsible for consulting a licensed healthcare professional regarding any medical decisions based on the Report.
4. Eligibility and Registration
To use the Service you must:
- Be at least 18 years of age, or act with the consent of a parent or legal guardian.
- Provide accurate and complete registration information.
- Maintain the confidentiality of your account credentials.
- Not share your account with third parties.
Legal entities may register institutional accounts. The individual completing registration accepts these Terms on behalf of the institution.
5. Placing an Order
To submit an Order:
- Log in to your account.
- Upload the ECG file(s) in a supported format (PDF, DICOM, image, or wearable export).
- Provide any relevant clinical context (optional but recommended).
- Review the price and confirm the Order.
- Complete payment.
The Order is accepted when payment is confirmed. You will receive a confirmation email.
6. Pricing and Payment
Current prices are displayed on the platform before you confirm an Order. All prices are shown exclusive of VAT; VAT at the applicable Latvian rate is added at checkout for taxable transactions.
Volume discounts are automatically applied based on the number of ECG episodes in a single Order, as shown in the pricing calculator.
Payment is processed by EveryPay, a licensed payment institution. We accept major credit and debit cards. Payment must be completed before an Order enters the interpretation queue.
7. Turnaround Time
We aim to deliver Reports within 24 hours of confirmed payment under normal operating conditions. Turnaround times may be longer:
- During weekends and public holidays.
- For complex or technically challenging recordings.
- During periods of unusually high demand.
Turnaround times are indicative and do not constitute a binding service-level guarantee.
8. ECG File Requirements
You must upload ECG files that:
- Are genuine electrocardiogram recordings.
- Are of sufficient technical quality for interpretation (legible traces, adequate speed and calibration).
- Are in a supported format: PDF, DICOM, PNG, JPG, or standard wearable exports (Apple Health, AliveCor).
- Belong to the patient whose data you are authorised to submit.
If an uploaded file is technically insufficient for interpretation, we will notify you and offer a re-upload or a refund.
9. Refund and Cancellation Policy
Cancellation before interpretation begins: You may cancel an Order and receive a full refund if the Report has not yet been started. Contact us at ekg@sablons.lv as soon as possible.
Unreadable ECG file: If we determine that the uploaded file cannot be interpreted due to technical quality issues, you will receive a full refund or may re-submit a corrected file.
Completed reports: Once a Report has been prepared and delivered, we do not offer refunds on the basis of disagreement with the medical opinion expressed. If you have concerns about the content of a Report, contact us and we will review.
Refunds are processed to the original payment method within 5–10 business days.
10. Intellectual Property
Reports: Once delivered and paid for, you receive a non-exclusive, non-transferable licence to use the Report for personal or institutional medical purposes. The Company retains copyright in the Report.
Platform: All software, design, trademarks, and content comprising the ekg-apraksti.lv platform are the intellectual property of the Company or its licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.
Your ECG files: You retain ownership of your ECG recordings. By uploading, you grant us a limited licence to process the files solely for the purpose of preparing your Report.
11. User Obligations
You agree not to:
- Upload files that do not belong to you or that you are not authorised to share.
- Provide false or misleading clinical information.
- Attempt to reverse-engineer, scrape, or otherwise misuse the platform.
- Use the Service for any unlawful purpose.
- Resell or redistribute Reports without authorisation.
- Impersonate another person or entity.
12. Data Protection
The processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Service, you acknowledge that you have read and understood the Privacy Policy.
13. Confidentiality
All cardiologists providing interpretations are bound by professional medical confidentiality obligations and by contractual confidentiality agreements with the Company.
Your ECG data and health information will not be disclosed to third parties except as described in the Privacy Policy.
14. Limitation of Liability
To the maximum extent permitted by applicable law:
- The Company is not liable for any indirect, incidental, special, or consequential damages arising from use of the Service.
- The Company’s total liability for any single claim shall not exceed the amount paid by you for the Order giving rise to the claim.
- Reports are professional medical opinions, not guarantees. The Company is not liable for adverse health outcomes resulting from a patient’s or clinician’s reliance on a Report.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud.
15. Indemnification
You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, and cardiologists from any claim, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your use of the Service, or your violation of any applicable law.
16. Service Availability
We aim to maintain high availability of the platform but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance where practicable. We are not liable for loss arising from temporary unavailability.
17. Account Suspension and Termination
We reserve the right to suspend or terminate your account with or without notice if:
- You breach these Terms.
- We suspect fraudulent activity.
- Required by law or court order.
You may close your account at any time by contacting us. Pending Orders will be completed or refunded before closure.
18. Third-Party Services
The Service integrates third-party services including payment processing (EveryPay), authentication (eID Easy), hosting (Vercel), and storage (Supabase). Use of these services is subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.
19. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Latvia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Latvia, unless mandatory consumer protection law in your country of residence provides otherwise.
20. Dispute Resolution
We encourage you to contact us first to resolve any dispute. If a dispute cannot be resolved amicably within 30 days, it may be referred to:
- The Consumer Rights Protection Centre of Latvia (PTAC) for consumer disputes.
- The competent Latvian courts.
EU consumers may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
21. Entire Agreement
These Terms, together with the Privacy Policy and any Order confirmation, constitute the entire agreement between you and the Company in relation to the Service and supersede all prior representations, agreements, or understandings.
22. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
23. Waiver
Failure by the Company to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
24. Changes to These Terms
We may update these Terms from time to time. The date at the top of this page indicates when the Terms were last updated.
For material changes, we will notify registered users by email or via an in-platform notification at least 14 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
