Buyer / Consumer:
A natural or legal person who places an order remotely through the ekg-apraksti system.
2. Subject-Matter of the Contract
The subject-matter of this Contract is a digital service under which the Buyer uploads an ECG file or related medical materials, and the Seller arranges for the evaluation of those materials and the preparation and delivery of an ECG interpretation report to the Buyer in digital form.
The Service may include:
- Account creation and access provisioning;
- Receipt and technical processing of ECG files;
- Referral of files for evaluation;
- Preparation of the ECG interpretation report;
- Delivery of the result to the Buyer’s account, by e-mail, or through another method provided for in the system.
3. General Terms for Ordering, Delivery, and Payment
An order is formed when the Buyer:
- Completes the required information;
- Uploads the required files;
- Confirms the order;
- Consents to the associated documents and required declarations;
- Makes payment, if the service is a paid service.
An order is deemed received once payment confirmation and order registration have been recorded in the system or by e-mail.
The price of the service is stated before the order is confirmed. Prior to the conclusion of a distance contract, the consumer must have clear information about the price, the service, and the principal terms.
“Delivery” of the service within the meaning of this Contract means the transfer of a digital result to the Buyer:
- In the user account;
- To the specified e-mail address;
- In PDF or another electronic format, if provided for in the specific order.
Payment is made using the payment methods available in the system. The Seller may use an external payment processor.
4. Specific Terms for Digital Content and Digital Service Delivery
The Buyer acknowledges and agrees that ekg-apraksti is a digital service performed in an electronic environment. The Consumer Rights Protection Law contains specific provisions for digital content and digital services, including provisions on delivery and non-conformity with the contract.
The result is delivered digitally, and performance of the service may commence immediately after:
- Confirmation of the order;
- Receipt of payment;
- Receipt of the required consents and confirmations.
The Buyer agrees that performance of the service commences immediately or before the expiry of the withdrawal period.
The Buyer understands and confirms that, as a result of such commencement of performance, the right of withdrawal may be restricted or extinguished to the extent provided for by applicable law.
If performance of the digital service has been fully completed at the Buyer’s explicit request and confirmation, the Buyer’s right of withdrawal may no longer be exercisable. If performance has commenced but has not been fully completed, the Buyer may be required to pay a proportionate amount for the part of the service already provided, in accordance with consumer protection legislation.
5. Rights and Obligations of the Parties
5.1. The Buyer is entitled to:
- Receive clear information about the service, price, and delivery timeframe;
- Receive the ordered service in accordance with the terms of this Contract;
- Submit complaints regarding service non-conformity;
- Exercise the right of withdrawal in the cases provided for by applicable law;
- Receive information about their order and data processing.
5.2. The Buyer undertakes to:
- Provide truthful, complete, and up-to-date information;
- Upload only files and data that the Buyer is entitled to submit;
- Not use the system for unlawful purposes;
- Make payment in a timely manner;
- Comply with this Contract, the Privacy Policy, and other associated terms;
- Where necessary, provide additional information if it is objectively required for performance of the service.
5.3. The Seller undertakes to:
- Provide the service in accordance with the published description;
- Ensure digital performance of the service within a reasonable timeframe;
- Review the Buyer’s complaints within a reasonable timeframe;
- Process personal data in accordance with the Privacy Policy;
- Notify the Buyer of material disruptions if they affect service delivery.
5.4. The Seller is entitled to:
- Refuse to provide the service if the submitted information is insufficient, technically invalid, or unlawful;
- Suspend or restrict access to the system for security, maintenance, or technical reasons;
- Decline an order if there are reasonable grounds to suspect fraud, misuse, or infringement of third-party rights;
- Amend the terms of the Contract by publishing an updated version.
6. Service Delivery Timeframe
The service delivery timeframe is indicated in the system, the service description, or the order confirmation. If a timeframe is stated as approximate, it is to be regarded as a good-faith estimate and not an absolute guarantee.
The timeframe may be affected by:
- The quality of the files submitted;
- The need to clarify information;
- Technical disruptions;
- Unavailability of third-party systems;
- Force majeure.
7. Right of Withdrawal
In a distance contract, a consumer generally has the right to withdraw from the contract within 14 days without giving any reason. In the case of service contracts, this period typically runs from the date of conclusion of the contract.
The Buyer may exercise the right of withdrawal by sending a clear notice to the Seller at the e-mail address indicated.
However, the Buyer agrees and confirms that:
- The Buyer requests that performance of the digital service commence before the expiry of the 14-day withdrawal period;
- The Buyer is informed that, as a result, the right of withdrawal may be restricted or extinguished entirely upon full performance of the service;
- If the service has already been partially performed at the time of withdrawal, the Seller may be entitled to retain a proportionate amount in respect of the part of the service already provided.
8. Pricing, Cancellation, and Refund Terms
A full refund may be possible if:
- The order is cancelled before performance of the service commences;
- The Seller is objectively unable to commence performance;
- Payment was received in error.
A partial refund may be possible if:
- Performance of the service has commenced but has not been completed;
- The Buyer exercises the right of withdrawal after performance has commenced, to the extent permitted by applicable law.
A refund may not be possible if:
- The service has been fully performed at the Buyer’s explicit request to commence performance before the expiry of the withdrawal period;
- The service has actually been received and the Buyer was duly informed of the restriction on the right of withdrawal.
Any refund due will be made within a reasonable timeframe using the same payment method, to the extent possible.
9. Complaint Procedure
If the Buyer has complaints about service performance or non-conformity of the result, a written complaint may be submitted to:
The complaint should include:
- The Buyer’s name and contact information;
- Order identification;
- A description of the issue;
- Relevant files or evidence, if available.
The Seller will review the complaint within a reasonable timeframe and provide a response as soon as possible, taking into account the complexity of the matter.
If the digital service does not conform to the contract, the consumer may, in certain cases, request that the non-conformity be remedied, a proportionate reduction in price, or cancellation of the contract.
10. Liability and Dispute Resolution
The Seller is not liable for:
- Losses arising from incorrect, incomplete, or misleading information provided by the Buyer;
- Consequences caused by improper or technically deficient file uploads;
- Disruptions to third-party infrastructure, the internet, hosting, authentication, or payment services;
- Indirect losses, to the extent permitted by applicable law.
All disputes shall first be resolved through negotiation. If agreement cannot be reached, the dispute shall be referred to the courts of the Republic of Latvia in accordance with rules of jurisdiction.
The consumer may additionally be entitled to use out-of-court dispute resolution mechanisms where provided for by applicable law.
11. Processing of Personal Data
Personal data and health data are processed in accordance with the Privacy Policy.
The Buyer acknowledges that:
- Performance of the service objectively requires the processing of health data;
- Without explicit consent to the processing of health data, provision of the service is not possible.
12. Storage of ECG Files
Unless a longer retention period is required by law, a security incident, or the examination of a dispute, uploaded ECG files are retained for 5 days from the date the ECG interpretation report is issued or from the date the order is cancelled.
13. Other Terms
The Seller may amend this Distance Contract by publishing an updated version on its website or in the system.
If any provision of this Contract becomes invalid, this shall not affect the validity of the remaining provisions.
This Contract is governed by the law of the Republic of Latvia.
